Restraining and Protective Orders

A Restraining Order can protect you from physical, emotional or financial abuse. It can order someone not to harass you or destroy your property. A Restraining Order can also prevent someone from staying in your home.

There are many different kinds of restraining orders available through the court system. Each order has different eligibility requirements.

  • Civil Harassment Restraining Orders - If you need protection from someone who is not, or has not been, a business partner and who is not a close family member. This restraining order could be used for protection from neighbors, roommates, or co-workers, for example.
     
  • Criminal Protective Orders - A protective order is an order a Judge makes to protect a witness or victim of a crime.
     
  • Domestic Violence Prevention Act (DVPA) Restraining Orders - This order protects a person from behavior such as physical violence, a verbal threat of physical violence, or a pattern of harassing behavior by someone the person wanting protection has or had a close relationship with (such as marriage, family relative, and currently or previously dating or living together).
     
  • Elder Abuse/Dependent Adult Abuse Restraining Orders - These restraining orders are meant to prevent mistreatment of an elderly person or a dependent adult - an adult who has physical or developmental disabilities, or failing physical or mental abilities caused by age.
     
  • Emergency Protective Order (on the Domestic Violence page) - These are for emergency situations. If you are in danger, ask a law enforcement officer to ask for an Emergency Protective Order from a Judge. An Emergency Protective Order only lasts for 5 court days or 7 calendar days.
     
  • Workplace Violence Restraining Orders - A business would file this if it needs protection for its worker(s).
