Family FAQ Answer to: How does someone apply for grandparent visitation rights?

The person should visit the Court's Self Service Center in downtown San Jose for help applying to the Court to have visitation time with grandchildren. We can provide the forms and help with filling them out, to ask the Court to make a new visitation order, without charge for the assistance.

The person will need to bring:

  • the son or daughter's divorce case number
  • the most recent visitation order for the children (from the Court at 170 Park Center Plaza for $1 per page side, or from the son or daughter) and
  • proof of income (if applying to not pay the Court filing fee)
