  1. Emergency Protective Restraining Orders

    If you need immediate protection -- at any time of the day or night, including weekends and holidays, call your police department, or call 911.

    Ask the law enforcement agency that responds to your call for an Emergency Protective Restraining Order.

    Emergency Protective Restraining Orders are short term. To get a restraining order that lasts longer, come to court or ask one of the agencies below for help.

    Family Form Generator You can also fill out (but not submit) your forms on line using the EZLegalFile Family Form Generator. You will be asked questions, starting with your county.
    Judicial Council The Judicial Council of California's website has the forms you need for family law cases. Download and print your PDF forms (using Adobe Acrobat), fill them out, and then file them with the Family Court. You may need local forms, too. You can get these from this site.
    Law Library The County Law Library has most of the resources you need. It is located at First and Julian Streets, in downtown San Jose.
    State Codes For the laws and codes related to your family law case, go to the Legislative Information website. (See also local and state rules and forms.)

  8. Can I get free legal services?

    The National Legal Services Corporation (like, Legal Aid Society and Legal Services Foundation) help low-income people who qualify for free. They do not help people with criminal cases.

    If you have been accused of a crime and need free help, talk to the Public Defender's Office.

    Or, when you first go to court, ask the judge to appoint the Public Defender to your case.
