Criminal FAQ Answer to: How can I find out about clearing my record?

A record clearance, or expungement, can only be done when there has been a conviction. In matters where there has been no filing of a criminal case, the law enforcement agency may be petitioned to seal its arrest records as outlined in Penal Code section 851.8. Because we cannot give you legal advice, you may wish to utilize a law library or consult an attorney.

If you were convicted and completed probation, you may qualify for record clearance. Read our Record Clearance web page at this site, by clicking on the link "Record Clearance" on the left side of the FAQ page. Visit the County Probation Department's Record Clearance web page (which has a link to their clearance form), or pick up a copy at the Hall of Justice (hours and directions). The application contains quite a bit of information about eligibility.

You may also want to contact your Probation Officer and ask about a record clearance.
